Navy To Use Sonar Despite Court Rulings
Act allows exemptions from environmental law during wartime

When it comes to complying with environmental laws, the U.S. Navy has proven to be as slippery as the marine mammals that federal statutes strive to protect.
Last August, the Navy said it would comply with the law and conduct the studies required to use high-intensity sonar at all its major ranges, including those around Hawai'i.
Conservation groups, seeking to spare whales, dolphins and other ocean animals from the potentially lethal affects of underwater sonar, breathed a sigh of relief. But recently the Pentagon announced that the Navy doesn't have to comply with the Marine Mammal Protection Act (MMPA) while it's conducting those studies.
Donald Schregardus, deputy assistant secretary of the Navy for the environment, said the Navy sought the exemption because "we cannot stop training for the next two years" while the studies are being done.
Schregardus is the same man who, last August, vowed the Navy would no longer attempt to circumvent the law, as it had done in seeking a six-month exemption from the MMPA to allow the Rim of the Pacific summertime war games to proceed in Hawai'i.
At the time, the Navy was facing litigation over its use of sonar in Hawaiian waters, just as it is currently facing a lawsuit over similar activities off the coast of Southern California.
The Pentagon's announcement came shortly after the California Coastal Commission declared that the Navy's proposed safety measures for the sonar exercises do not adequately protect marine life. The commission urged the Navy to adopt a number of additional provisions before conducting its planned training.
Instead, the Navy appealed to the Pentagon, and it invoked the 2004 National Defense Authorization Act, which allows the Department of Defense (DOD) to grant itself categorical exemptions from environmental laws during times of war.
In a three-paragraph memorandum, Deputy Defense Secretary Gordon England excused the Navy from all provisions of the MMPA in its use of high-intensity, mid-frequency sonar for a period of two years and stated that, in that time, the Navy would "execute the plan coordinated with the Department of Commerce to come into full compliance" with the MMPA.
Joel Reynolds, a senior attorney with the Natural Resources Defense Council, says the exemption is "a clear admission by the U.S. Navy that its current operations violate the protective standards" for marine mammals. "It's not that the Navy can't comply with the law. It's that the Navy chooses not to."
Reynolds and other lawyers, representing conservation groups in the fight against the Navy's unfettered use of sonar, plan to proceed with their lawsuit, anyway, contending the training exercises also violate other federal environmental laws.
"The Navy has more than enough room in the oceans to train effectively without injuring or killing endangered whales and other marine species," Reynolds says. "Whales and other marine mammals shouldn't have to die for practice."

Presence and breath to you all my friends of the globe.
I am blessed to be here and grateful to all of you who reflect success around me!
Aleia is sleeping soundly tonight in her new room in the intermediate
care unit. She is healing at rapid speeds. After writing
this email I will return to sleep with her this evening as Nicole seeks
rest and santuary at the hotel. We were transferred today to the
same room we left two weeks ago! Halleluah and as we
returned Aleia was happily greeted by all of the amazing I am U
(Intermeddiate Care Unit) angels. We also got the stretch limo
crib which is big enough to lay next to her in bed. We have made
many friends here at this gathering of spirits. A great mending
tree for us all.
I look at Aleia's scar on her chest and
realize the reflection of her truly opening her heart to us!
Aleia is my messenger and on this road I chart the direction
home. I call upon you the universe the grand collector of
all, I am ready to receive the Sanctuary home of our living well,
to provide a safe and nurturing space where abundance of life is
shining in our lives, a peaceful foundation in which to dig our roots
deep and honorably in symbiance as our family grows. I am
creating the essence of music to radiate from my healing soul and
provide a source of service to all. Aleia, swinmming next to
Nicole, Raven, Blaize and I at the beach.
Golden rivers of consciousness embracing the goodness of our spirit, vibrating with breath.
Rented biodiesel tours exploring the organinc mountain farms, childrens
books published from the press of Mrs. Soul, Sacred Designs

music with the children, sharing the love expression though action!

gratitiude for the prisoners and those fighting in the war for?

Wednesday, March 7
Today we enter a new chapter in this amazing adventure. Around 7 pm we return to room 323 in the IMU. As we settle in Keith mentions a "wrinkle in time." Our little "wrinkle" has been the space of two weeks and in those two weeks, two heart surgeries. Our daughter's chest opened and closed twice, 13 days with only iv fluids "to eat,"
a beautiful man sharing his time, focus and strengths with our daughter. There is a new universe of intimacy in our lives as we share the care of our daughter with nurses and doctors plenty. We now have a new caregiver every twelve hours, twice a day "getting to know" the person who will give care to our daughter.
Tomorrow, Aleia will have her final of two chest tubes removed. We will be able to hold her as much as we want. Breast feeding will return to normal. Aleia will still need some healing on her leg, though soon we will return to the Big Island. She has many scars across her beautiful little body-I always said i would love to do a book on scars and their stories, perhaps keith will be the photographer.
For now I retire, to deep breathing in the Delta way, Thank you Cassandra!

Today the shadow cast as the moon danced in front of "Kala" the
sun. A time of inner strength and the determination to follow
through! Earth changes abound and the simple term "Love thy
Neighbor" is commanded through our consiousness and will to heal.
From the North to the South the East and West may our energies be
unified! Connected to source we gather to bring light and
change. From the roots, finding the water once only thought
to be there. The wellspring now full as we embrace the
stars. Bring health to all who seek its temple. Breath to
the core to inspire the life flow within our physical vessels!
It is Sunday evening as I sit in the "Living Room" lobby of our
hotel preparing the networks facillitating our
journey home. Aleia is peacefully sleeping with her mommy
in the castle of health called "Rady Children's Hospital". There
is only room for one of us to sleep there, so it is my honor to be
doing this work as I prepare the gound for us to walk back to our
sanctuary on the Big Island of Hawai'i.
Tomorrow we begin our discharge process from the hospital and we will
see many doctors and pack up our temporary home. Then, move into the
hotel room for two additional weeks to stay close by and attend
periodic visits to monitor Aleia's heart. My gratitude
emanates in all directions, blessed by the beauty of god and goddess in
all their names surrounding us in this amazing and epic walk. A
change of the four months we have been hospitalized. Aleia's
grandpa and Auntie arrive tommorrow evening to meet her for the first
time. I know she feels them coming!
Wednesday the 21st I will make the journey to Austin and join a team of
world changing visionaries at the Vision Force Bootcamp. As a
part of a global competion, social change agents from all over were
asked to submit applications describing thier idea of vision and the
tools inside required to get there. On the 21st of February the
selected participants were announced and I recieved my invitation to
attend. The Vision Force Bootcamp is a four day intensive joining
30 changemakers together to resource the necessary tools to facilitate
the vision. I am honored to be chosen and very excited to
attend! After the event I will visit my father, who will
drive down from a little town named San Angelo and share an early birth
day together. We are both born April 5th.
It brings me great joy to bring these tools back to our communities, and begin the rest of our lives this way.
Community health and wellness brings about a whole new meaning as we
return to our projects back on the Big Island. We are standing to
empower our local island communites through sustainable methods and
encouaging local economic development. We are networking the
communities to become allies effecting the greater change. Our
Health and Wellness market place will serve as a model to other
community entreprenuers focusing on Concious Capitalism. Through
the eyes of a village we are building a space to gather, to experience
the joys of connection, honor the culture and perpetuate its beauty,
educate and nourish our youth, heal and move our bodies and express our
souls. As we share the tools of sustainability, health and
wellness is achieved and once again we move forward in ease.
I honor you all in your journeys, I honor my self in mine. We are
all blessed in infinite rays of abundance and love. Remember to
breathe, I reflect this to myself again as I breathe with you.
